ESPERANZA BRINGAS ALVAREZ may modify these conditions at any time, being duly published as they appear here. The validity of these conditions will depend on their exposure and will remain in effect until they are replaced by others duly published. The latest modification of the conditions is dated 18/11/2020.
SECURITY

PLACEMENT OF ORDERS

The prices presented on the website are valid exclusively for online orders placed on www.animawomenssurf.com. All prices published on our website include VAT.
The validation of the order by the customer explicitly implies knowledge and acceptance of these general contracting conditions as part of contract formation.
Once the purchase is made, and within as short a time as possible, always within 24 hours from executing the purchase, ESPERANZA BRINGAS ALVAREZ‘s Customer Service will send you a purchase receipt via email.
If you disagree with the details stated in this confirmation, you may request their modification or contract cancellation.

PRODUCT AVAILABILITY
The selection of products offered on www.animawomenssurf.com is valid as long as they are visible on the website. Since it is electronic commerce, stock is updated online, so it could happen that stock runs out during the purchase process.
If this occurs, we will inform you immediately to offer an alternative or refund the amount paid for the product.
HOW TO MAKE CLAIMS
To make any claim regarding obligations established in Article 110 of Law 3/2014, please contact us.
LACK OF CONTRACT EXECUTION
If the contract cannot be executed due to product unavailability or any other reason, customers will be informed about this lack of availability and/or justification for it. They will recover without undue delay any sums paid under this contract. In case of unjustified delay by ESPERANZA BRINGAS ALVAREZ regarding refunding paid sums, customers may claim double the owed amount without prejudice to their right to compensation for damages exceeding this amount.
SHIPPING METHOD AND TIMES
Products are shipped to the delivery address indicated in your order. If placing an order for multiple items with different availabilities, dispatch time will consider the longest delivery estimate. In exceptional cases, ESPERANZA BRINGAS ALVAREZ reserves the right to split orders by sending available items first while leaving unavailable items for a second shipment.
To carry out transportation and delivery of shipments, we have chosen a reputable courier company.
The established shipping time depends on your order. It will be approximately five working days from payment receipt (working days are Monday through Friday).
If customers detect any issues upon delivery (damaged packaging, missing or deteriorated products), they must indicate this in writing on the carrier’s delivery note and contact us within 14 days following receipt. No damaged item returns or missing item claims will be accepted if not communicated within this period along with photos and problem descriptions.
This does not affect consumers’ warranty rights for products non-compliant with contracts under current regulations.

PAYMENT
ESPERANZA BRINGAS ALVAREZ accepts payment by Credit Card (Visa and MasterCard). If paying with Visa or Maestro cards, charges will be deferred until shipment (only shipped items are charged at shipment). If TPV reports card denial, orders are automatically canceled with online notification. For payments made with cards issued outside Spain, issuing banks must adhere to Secure Electronic Commerce Protocol (CES). Cards not meeting this requirement are not accepted. Alternatively, payment by bank transfer is available. ESPERANZA BRINGAS ALVAREZ reserves rights to reject credit card transactions; refunds will be processed back onto original cards. Customers interested in continuing purchases after rejection must use bank transfers.
RIGHT OF WITHDRAWAL
If unsatisfied, return purchases made on www.animawomenssurf.com at our office located at Paseo marítimo del puertillo 11 2A - El puertillo (35414 Arucas), completing withdrawal documents downloadable here.
Maximum return request deadlines from order receipt:
-14 calendar days for all online store products.
Refunds are processed using original payment methods. This right complements warranty rights recognized under RDL 1/2007 (16 November) concerning consumer protection laws.
Return circumstances include:
a) Unsatisfactory products: Return via courier to ESPERANZA BRINGAS ALVAREZ. Product costs refunded excluding return shipping.
b) Exchanges: Return shipping costs not covered by ESPERANZA BRINGAS ALVAREZ.
c) Incorrectly sent products: ESPERANZA BRINGAS ALVAREZ covers collection costs for incorrect items plus correct item delivery.
d) Products must remain sealed/unopened with intact packaging/accessories/instructions for returns.
Returns from physical stores or online stores not purchased from this entity are not accepted.
Products must remain in perfect condition with original packaging/manuals/accessories/promotional gifts included.
Article 103 (Law 3/2014) excludes withdrawal rights for customized products or those meeting customer specifications.

ORDER CANCELLATION
Canceling orders before dispatch incurs no charges. Canceling post-dispatch incurs shipping plus return costs borne by customers.
PRODUCT WARRANTY
Warranty lasts two years post-delivery excluding negligence/damage/misuse/wear-related deficiencies. Faults appearing within six months post-delivery presume pre-existing unless incompatible with product nature/fault type. ESPERANZA BRINGAS ALVAREZ may request official brand technical service verification; misuse-induced defects incur repair charges. Valid warranty cases allow repair/replacement/reduction/refund per legal terms.
REFUNDING PAID AMOUNTS
Refunds occur via original payment methods after verifying returned item’s condition/accessories at warehouses. Refunds exclude transport costs; maximum processing time is 15 days post-verification.
APPLICABLE LAW AND JURISDICTION
Relations between ESPERANZA BRINGAS ALVAREZ and USERS follow current Spanish law; disputes fall under courts corresponding to designated cities.
